These Terms of Service ("Terms") govern your access to and use of the HypeHeat website, dashboard, and Discord bot (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your country to use Discord) to use the Service. By using HypeHeat you represent that you meet this requirement.
2. Account & Access
Access to the Service requires authentication via Discord OAuth. You are responsible for all activity that occurs under your Discord account when used to access HypeHeat. Notify us immediately if you suspect unauthorized access.
3. The Service
HypeHeat provides:
- A web dashboard for resellers to track checkouts, orders, shipments, and email-based order confirmations.
- A Discord bot that links Discord servers and channels to the dashboard for capturing checkout events and posting updates.
- Community-facing pages including success feeds and public profiles.
Features may change, be added, or be removed at our discretion. We aim to give reasonable notice for material changes but are not obligated to do so.
4. Acceptable Use
You agree not to:
- Use the Service for any illegal, fraudulent, or harmful purpose.
- Attempt to access data, accounts, or systems you are not authorized to access.
- Reverse engineer, decompile, or attempt to extract source code from the Service.
- Interfere with or disrupt the Service, including by automated scraping, denial-of-service activity, or abusing rate limits.
- Use the Service to harass, threaten, or impersonate others, or to distribute spam, malware, or unlawful content.
- Misrepresent your identity, including by attempting to claim a public profile that is not yours.
5. Discord Bot & Server Permissions
Where you add the HypeHeat bot to a Discord server you administer, you grant the bot the permissions you select during installation. The bot may read messages and channel data necessary to provide the Service in channels where it is present. Discord remains a third party governed by its own Terms of Service.
6. User-Submitted Content
Profile content you provide (bio, banner image URL, social links, Discord invite) and success-feed posts captured from designated channels are submitted by you. You represent that you have the right to submit such content and grant HypeHeat a non-exclusive, worldwide, royalty-free license to host and display it as part of the Service. You may remove content you submitted at any time via the dashboard or by request.
7. Service Availability
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability and may suspend the Service for maintenance, updates, or operational reasons. We are not liable for losses caused by Service downtime.
8. Suspension & Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms, abuse the Service, or if continued access would expose us or other users to legal, security, or operational risk. You may stop using the Service at any time by removing the bot from your servers and signing out of the dashboard.
9. Disclaimers
HypeHeat is a tool to assist resellers. We do not guarantee the accuracy of email parsing, tracking data, or any third-party-sourced information. Order confirmation and tracking data are derived from emails and external services and may be incomplete, delayed, or inaccurate. You are solely responsible for verifying critical information before relying on it.
10. Limitation of Liability
To the maximum extent permitted by law, HypeHeat and its operators are not liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid us (if any) in the 12 months preceding the claim.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by updating the "Effective" date above and, where appropriate, in-app notification. Continued use of the Service after changes constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the United States and the state in which HypeHeat is operated, without regard to conflict-of-laws principles. Any dispute will be brought in the courts of that jurisdiction.
